Article 1 — Purpose

These Terms of Use (hereinafter "TOU") define the terms and conditions for accessing and using the website mecantara.com (hereinafter the "Site"), published by OMAD GROUP, a EURL registered with the Paris Trade and Companies Register under SIREN 100 192 830, whose registered office is located at 6 rue d'Armaille, 75017 Paris.

Access to and use of the Site imply full and complete acceptance of these TOU. If you do not accept these terms, you must stop using the Site.

Article 2 — Definitions

• "User": any natural person accessing the Site, whether or not they are a customer.
• "Customer": any User who has placed and paid for an order through the Site.
• "Service": A personalized song created by MeCantara. Listen here!
• "Content": all elements of the Site (texts, images, logos, sounds, videos, code, structure).

Article 3 — Access to the Site

The Site is accessible free of charge from any device with Internet access. Costs for access to and use of the telecommunications network are borne by the User, according to the terms set by their access provider.

OMAD GROUP makes every effort to ensure the Site is available 24 hours a day, 7 days a week. However, access may be interrupted at any time, particularly for maintenance, updates or in cases of force majeure, without this engaging OMAD GROUP's liability or giving rise to any compensation.

Article 4 — Registration and user account

Use of the Service does not require creating an account. The User provides their information (first name, email, phone number) when completing the personalization form.

The User guarantees the accuracy and truthfulness of the information provided. They undertake to inform the Provider of any change to their contact details.

Article 5 — Use of the Site

The User undertakes to use the Site in accordance with its intended purpose and in particular to:

• not attempt to bypass, disable or interfere with the Site's security measures;
• not use robots, automated scripts, scraping tools or any other automated means to access the Site or extract data from it;
• not distribute unlawful, offensive, defamatory, discriminatory content or content contrary to public order through forms or any other communication channel with the Site;
• not impersonate a third party;
• not disrupt the normal operation of the Site (DDoS attacks, injections, etc.);
• provide accurate and lawful information in the personalization form;
• respect the intellectual property rights of OMAD GROUP and third parties.

Any breach of these obligations may result in immediate suspension of access to the Service, without prejudice to damages.

Article 6 — Intellectual property

All Content on the Site is protected by intellectual property law (Articles L.111-1 et seq. of the French Intellectual Property Code). It is the exclusive property of OMAD GROUP or is used under authorization.

Any reproduction, representation, modification, distribution, retransmission or publication, even partial, of the Content is strictly prohibited without OMAD GROUP's prior written authorization.

The "MeCantara" trademark, logo and all distinctive signs are the property of OMAD GROUP. Any unauthorized use constitutes infringement punishable under Articles L.713-2 et seq. of the French Intellectual Property Code.

Article 7 — Content provided by the User

By providing information through the personalization form (texts, names, anecdotes, memories), the User guarantees that they hold all necessary rights to this information and that it does not infringe third-party rights.

The User grants OMAD GROUP a non-exclusive, worldwide license, for the duration necessary to perform the Service, to use this information solely for the purpose of creating the ordered song.

Article 8 — Hyperlinks

The Site may contain links to third-party sites. OMAD GROUP has no control over these sites and disclaims any responsibility for their content, availability, personal data protection practices or any damage that may result from consulting them.

Article 9 — Cookies and trackers

The Site uses cookies and trackers divided into two categories:

• Strictly necessary cookies: essential for the operation of the Site (session, CSRF security, technical preferences). They do not require your consent.
• Audience measurement and advertising cookies: Meta Pixel (Facebook/Instagram) for conversion measurement and advertising targeting. These cookies are only placed after obtaining your consent in accordance with Article 82 of the French Data Protection Act.

You can change your cookie preferences at any time through your browser settings or by using a tracker-blocking extension. Deleting necessary cookies may affect the operation of the Site.

Article 10 — Personal data protection

OMAD GROUP processes Users' personal data in accordance with the GDPR (EU Regulation 2016/679) and the amended French Data Protection Act of January 6, 1978.

Article 11 — Limitation of liability

OMAD GROUP strives to keep the Site accessible and information up to date, without being able to guarantee the complete absence of errors, interruptions or viruses.

Use of the Site is under the User's sole responsibility. OMAD GROUP cannot be held liable for:

• direct or indirect damages resulting from the use or inability to use the Site;
• loss of data or any other intangible loss;
• the content of third-party sites accessible through hyperlinks;
• any viruses or malware encountered while browsing.

Article 12 — Changes to the TOU

OMAD GROUP reserves the right to modify these TOU at any time and without notice. Changes take effect as soon as they are published on the Site. The User is invited to consult this page regularly. Continued use of the Site after modified TOU are published constitutes acceptance of the new terms.

Article 13 — Applicable law and jurisdiction

These TOU are governed by French law. In the event of a dispute relating to their interpretation or performance, and failing an amicable resolution, French courts shall have jurisdiction, subject to mandatory jurisdiction rules applicable to consumers.
